Anti-Money Laundering (AML) Compliance in UAE

Money laundering involves disguising the origin of illegally obtained funds by passing them through legitimate financial systems to make them appear legal. The UAE treats money laundering and terrorist financing as serious threats to its economy, security, and integrity. To counter this, the UAE has enforced strict AML/CFT (Counter Financing of Terrorism) laws, aligned with FATF (Financial Action Task Force) guidelines.

What Is AML Compliance in UAE?

AML/CFT regulation in the UAE encompasses legal, regulatory, and operational frameworks. Entities must register and report suspicious activities through regulatory channels like the UAE Financial Intelligence Unit (FIU) via goAML. These regulations apply not just to financial institutions, but also to certain non-financial businesses known as DNFBPs (Designated Non-Financial Businesses & Professions).

Key AML Obligations in UAE

  • Customer Due Diligence (CDD): Verify your clients’ identities, maintain updated records, and monitor ongoing transactions.
  • Enhanced Due Diligence (EDD): For high-risk clients, collect additional documentation and scrutiny.
  • Suspicious Transaction / Activity Reporting (STR/SAR): Identify & report unusual activity to the FIU.
  • Record-Keeping: Maintain client documentation and transaction records for at least 5 years.
  • Internal Controls & Compliance Programs: Appoint a compliance officer, define policies, monitor, and provide training.
  • Client Risk Assessment: Evaluate risk factors like geography, business nature, transaction complexity, etc.
  • Cross-Border Transfer Reporting: Report unusual or large cross-border movements.
  • Cooperation with Authorities: Respond to requests from regulatory or law enforcement bodies.

Who Must Comply (DNFBPs)?

Non-financial entities under AML obligations include real estate agents, legal professionals, accountants, auditors, notaries, dealers in precious metals & stones, and company service providers. These must follow sector-specific AML rules, particularly around large cash transactions and high risk clients.
